The following individual persons shall be eligible for coverage under the MHIP-PCIP if they have been legally domiciled in this state and can show that:

• they are a citizen or national of the United States or are lawfully present in the United States; AND
• they have not been covered under creditable coverage for a continuous 6-month period prior to the date on which they are applying for coverage in the MHIP-PCIP; AND
• they have had a problem getting insurance due to a pre-existing condition
